4% of Americans are cancer survivors. That’s well over 10 million people. Every year in the US alone , 550,000 die as a result of cancer and 1.5 million new cancers are diagnosed.
America’s over 10 million cancer survivors move forward with their lives with increasingly specialized legal needs. To assist survivors in asserting their legal rights, especially against insurers, Childress Duffy Goldblatt is proud to be the presenting sponsor for a Friday June 18, 2010 Cancer Rights Conference at Loyola Law School in Chicago.

The 2010 Cancer Rights Conferences are results of the great work of the Cancer Legal Resource Center (CLRC), a joint program of the Disability Rights Legal Center and Loyola Law School Los Angeles. The CLRC is a national, nonprofit organization that provides information and resources on cancer-related legal issues to people coping with cancer. The CLRC is the only national effort aimed at specifically asserting the legal rights for persons with all types of cancer. |

| 02.24.2010 – The Ashley Condo Management Association, Inc. v. Citizens Property Insurance Corp.
On February 24, 2010, CDG obtained a $2.8 million jury verdict for the owners of The Ashley Condominium Association against Florida’s state-run property insurer for damages sustained during Hurricane Frances in 2004. Citizens Property Insurance Corporation denied the Daytona Beach area condo’s claim following the hurricane, eventually forcing The Ashley to litigate its right to payment under the insurance policy, culminating in an eight-day jury trial in Volusia County. The verdict is the latest in a string of successful results obtained by CDG for condominium associations damaged by hurricanes in 2004 and 2005. |

On December 16, 2009, associate Christina M. Phillips settled a complex construction defect case. Plaintiffs discovered damage to the flooring of their dental office nine years after it had been remodeled. It was determined that a dental vacuum pipe had been improperly vented during remodeling. Plaintiffs sustained damages to repair and replace building components as well as loss of business income. Plaintiffs pursued their action against the general contractor, who was bankrupt, to the extent of his commercial general liability insurance policy. Ms. Phillips successfully settled for more than half a million dollars. |

| 12.04.2009 Chinese Drywall Lecture
On December 4, 2009, Edward Eshoo Jr., guest lecturer at the National Association of Public Insurance Adjusters Mid-Year Meeting discussed how the courts would find some of the damage resulting from Chinese drywall would be covered under a first party property insurance policy. Ed’s discussion of the commercial and homeowners policy forms were excellent and received rave reviews from those who attended. His discussion regarding the science of drywall, covered risks, ensuing or resulting damage, causation, and exclusions were clear and simple.

| 11.18.2009 Insurance Roundtable hosted by the Florida Department of Financial Services. On November 18, 2009, CDG partner Chris Mammel attended a Roundtable at the Capitol Building in Tallahassee hosted by Sean Shaw, the Insurance Consumer Advocate for the State of Florida, Department of Financial Services. The Roundtable was one of several recent sessions focusing on insurance claim disputes, and possible means to improve the claim settlement process. In-house counsel for several large insurance companies and building contractors joined Mr. Shaw on the Roundtable. Industry experts spoke on the topic and interested members of the audience, including Mr. Mammel, commented.
The Roundtable was useful and informative, so the Insurance Consumer Advocate’s Office has recently scheduled another Roundtable for January 2010 focusing on alternative dispute resolution, including the appraisal process authorized under most property insurance contracts. Mr. Mammel has been invited to join the Roundtable along with a select group of legal representatives of Policyholders, in-house insurance company counsel, Public Adjusters, and professionals who act as appraisers and umpires in the appraisal process.
Alternative dispute resolution options are of critical importance to Policyholders, and with the recent actions of several insurance companies to remove or severely limit the binding appraisal remedy historically available to insureds, new means to promptly obtain the intended policy benefits need to be fashioned. The Insurance Consumer Advocate’s Office is an important link to potential legislative solutions to this problem, and Childress Duffy Goldblatt is pleased to be given a seat at that table. |

11.06.2009 Oyos v. State Farm
On November 6, 2009 CDG tried and won a case against State Farm Insurance Companies.
The Oyos family’s home burned in a fire on December 2, 2003. State Farm denied the claim for alleged arson. The Jury awarded the Oyos family $383,000 for damages. |

08.03.2009 La Mer Condo v. Citizens
On August 3, 2009, in La Mer Condominium Association, Inc. v Citizens Property Insurance Corporation, 2007 30089, Volusia County (Judge Richard Graham), CDG defeated Citizens’ Motion to Dismiss La Mer’s claim under Fla. Stat. Section 624.155 asserting various violations of Citizens’ duties of good faith toward its insured. La Mer is seeking to recover damages for Citizens’ handling of La Mer’s 2004 windstorm claim. Citizens contends that it is immune from liability under section 624.155 and therefore may act toward its insureds in ways that would constitute acts of “bad faith” under the statute if committed by insurers in the private market. Citizens has sought extraordinary relief from the Fifth District Court of Appeals in an attempt to overturn Judge Graham’s decision before discovery into its claims practices can be obtained. |

07.23.2009 - Inlet Condominium Association
On June 1, 2009 CDG tried and won a case in Daytona Beach, FL against Citizens Property Insurance Company. The Inlet Condominium was damaged by the 2004 hurricanes. The Jury awarded the Condo Association $3.3 million for damages.

07.05.2009 - Risk Assessment & Transfer International hired to represent Patrick Cudahy, Inc.
A fire ignited at the Patrick Cudahy meat plant in Cudahy, Wisconsin over the Fourth of July weekend. The blaze burned for about three days and forced an evacuation of hundreds of surrounding residents. Initial damage estimates are more than $50 million. Risk International's disaster response team was immediately onsite working with the company, local authorities, and gathering the top contractors to respond to this disaster to ensure that the Cudahy plant can continue to run its business.
